Carefully read the following terms and conditions before engaging in any activity at our premises as they can impact your legal rights.
Website and domain https://funpoint.ae (Fun Point) are under the control and ownership of Fun Point Amusement Toys Rental through which we sell our products, events, and tickets in our activity park.
GENERAL
By purchasing a ticket from Fun Point you and your dependents agree to the terms and conditions mentioned. In case of purchasing a ticket for another person, you are obligated to sign a waiver form and be the authorized guardian of that person. You acknowledge and agree that you will ensure that all members of your party are aware of and they accept the terms and conditions of Fun Point. Fun Point Amusement Toys Rental is registered under license number 207336 and we offer sports and recreational facilities with activities including a Foam pit, Climbing wall, Ninja warrior, Devil slide, Donut slide, Trampoline, Ball pool, High-performance trampoline, Toddlers zone, Workshop, other equipment, and birthday parties. All visitors of Fun Point Amusement Toys Rental and their dependents are voluntarily participating in the activities offered by Fun Point including, but not limited to, the use of the equipment, facilities, and premises. Using Fun Point’s facility and equipment has inherent risks, which include the risk of serious physical injury and potentially death. In spite of the risks mentioned above, every visitor freely participates and as such, assumes all of the risk and responsibility for the injury, death, or disability that may result to them or their dependents when purchasing a ticket.
SAFETY
You agree that you and/or your dependents are voluntarily participating in the activities offered by Fun Point including, but not limited to, the use of the equipment, facilities, and premises. You assume on behalf of yourself and/or your dependents, all risk of personal injury, disability, and potential death that may result from participation, as well as any damage, loss, or theft of any personal property which may incur to you and/or dependents. I understand that the Fun Point facility has a Foam pit, Climbing wall, Ninja warrior, Devil slide, Donut slide, Trampoline, Ball pool, High-performance trampoline, Toddlers zone, Workshop, and other equipment and that using Fun Point’s facility and equipment have inherent risks, which include the risk for serious physical injury and potentially death. Further, you explain these risks to your dependents. In spite of the risks mentioned above, you freely participate and as such, you assume all of the risk and responsibility for the injury, death, or disability that may result to you or your dependents when purchasing a ticket.
You are aware that it is advisable to consult a doctor or physician before undertaking any physical activity. You warranty that you and/or your dependents do not suffer from any medical condition, and/or incapacity which may impair you and/or your dependent’s ability to use and participate in the activities and services and further, that you and/or your dependents do not suffer from any heart condition, epilepsy, allergies, skeletal conditions, spinal, history of sports injury or any other medical condition such as pregnancy which may result in us placing ourselves in a position of risk by participating in the activities/services. You are aware that pregnant individuals are not permitted to take part in any of the activities at Fun Point. You also agree that you are responsible for any and all medical costs, including, but not limited to ambulance, hospital, pharmacy, physiotherapy, psychological, and rehabilitation.
You understand that you and/or your dependent will be engaging in recreational sporting activities while using Fun Point facilities. It is your voluntary and informed decision to, on behalf of yourself and dependents and our personal representatives, successors, and heirs, forever release any liability, lawsuits, or claims that we may have against Fun Point, its employees, directors, owners and its subsidiaries and affiliates (the Releases), to the fullest extent allowed by law, arising out of any damage, loss, personal injury, or death to me or my dependent’s, while participating in any of the activities offered at the Fun Point facility. This includes, without limitation, the use of a Foam pit, Climbing wall, Ninja warrior, Devil slide, Donut slide, Trampoline, Ball pool, High-performance trampoline, Toddlers zone, Workshop, and any other activities in and around the Fun Point facility. This release is valid and effective whether damage, loss, or death is the result of any act or omission on the part of any Releases or from any other cause. Therefore, you agree to hold the Releases, as well as the property owner, manufacturers, and installers of the equipment harmless from any and all claims or causes of action arising out of you and/or your dependent’s participation at the facility, including breach of contract or any such claims for negligence. Fun Point staff is not responsible for supervising your children irrespective of their age. All participants have to act responsibly at all times and respect other visitors of Fun Point. All jumpers and participants must wear appropriate clothes and wear socks provided by Fun Point when jumping and performing physical activities on the playground. Visitors, who are barefooted or wearing unapproved socks, high – heels, flip – flops, or any other unsuitable footwear, will not be allowed to enter the playground and will be escorted from the play area by Fun Point staff. Any decision by Fun Point staff is final.
CLOTHES
Respectful and appropriate clothing is the responsibility of all visitors of Fun Point and is advised to wear clothes that are appropriate for the activity and it is not minded by visitors to get damaged. Long hair must be tied back, hair clips can be used only if they are not sharp, pins and jewelry, such as earrings, wristwatches, bracelets, necklaces, etc. are prohibited to wear due to safety reasons. Fun Point is not responsible for any damage or loss of personal items.
BOOKING
With Terms and Conditions, you acknowledge and agree to the inclusive School and College Terms and Conditions and Party Terms and Conditions. All party and other events guests need to fill in and sign a waiver form online prior to the party day. The completed waiver form is mandatory for all minors by a parent or legal guardian before entering the park. Deposit is non – refundable as per the terms and conditions of the particular event type. Each party will be allocated a party slot. Party slots follow very strict time restrictions and any lateness will result in lost time from your party. Please ensure that your party guests arrive at the venue at least 15 minutes before the time of your booking as we are unable to add extra time to the end of your party slot. Food and drink are strictly prohibited on the playground. Any Food and beverage from outside are not allowed with exception of baby food or infant milk and you will be asked to leave in case of violating these terms. Drugs, consumption of alcohol, smoking, and chewing gums are strictly prohibited on Fun Point premises.
LIABILITY
Any loss or damage is not the responsibility of Fun Point. Personal items and property are the responsibility of the visitors and not Fun Point. The costs that may occur to protect your welfare or the welfare of any of your dependents in the incident of personal injury, including any emergency medical treatment and ambulance transportation is bearable by you (visitor) and not Fun Point. You permit Fun Point to take any action in order to protect your and your dependent’s welfare and safekeeping. By agreeing to these Terms and Conditions you agree that you will not take any legal actions against Fun Point Amusement Toys Rental.
OTHER
These Terms and Conditions include our Refund Policy and Privacy Policy. You acknowledge and agree to use any photo or video material taken on the Fun Point premises for security and/or marketing purposes, which can include images of yourself and your dependents including minors. You acknowledge and agree that the photographs and video material can be shown on social media platforms and use of those materials is not intended to insult, defame or slander any person. Fun Point reserves the right to suspend or cancel your participation in any of its activities for reckless or careless conduct or for non – compliance with the Terms and Conditions, Refund Policy, and Privacy Policy. Any intentional damage and misuse of property and equipment of Fun Point caused by you or your dependents will be charged to the person responsible for the booking of the violator’s guardian. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United Arab Emirates and you submit to the exclusive jurisdiction of the courts of UAE.
